Any order placed on www.vito-nebula.com implies the acceptance of these General Conditions of Sale by the Customer.

The Customer acknowledges having read these General conditions of sale before finalizing his purchase. The Customer also acknowledges having accepted these General conditions of sale by ticking the box provided for this purpose that he must manually tick before making his purchase.

Definitions

"Customer" means the individual or professional who has placed an order for a product on the website www.vito-nebula.com

"Original work" means the original paintings, painted on canvas.

"Print" means the reproductions of the original works on poster.

PRODUCTS

The products on sale on www.vito-nebula.com are presented by product sheets that indicate the characteristics of each work such as its size or the type of paint used (non-exhaustive list).

www.vito-nebula.com reserves the right to modify, adjust, delete or add products at any time without informing users.

Original works

The photos on www.vito-nebula.com try to reflect each work and its quality. However:
Slight color variations between screens and physical ink may exist;
Minor defects, which do not in any way diminish the overall quality of the works, may not appear in the photos.

At the time of purchase and by accepting the General conditions of sale, the Customer undertakes not to interpret the elements cited above as non-conformities that may lead to the cancelation of the sale.

Prints

The photos on www.vito-nebula.com try to reflect each work and its quality. However:
Slight color variations between screens and physical ink may exist;
Slight differences in framing and trimming may occur during production
The above items are considered normal during the custom printing process and cannot be returned or refunded.

At the time of purchase and by accepting the General conditions of sale, the Customer undertakes not to interpret the elements cited above as non-conformities that may lead to the cancelation of the sale.

Product unavailable

In case of unavailability of a product from www.vito-nebula.com (original works) or its provider (prints), www.vito-nebula.com undertakes to notify the Customer. The two scenarios are as follows:
- Temporary unavailability of the product: the estimated additional period is communicated to the Customer and the latter is able to request to cancel his order and to proceed to its full refund.
- Permanent unavailability of the product: the order is canceled and the order is refunded in full.

Reimbursement

The conditions for reimbursement are specified in Article 4. RIGHT OF WITHDRAWAL, RETURNS AND REFUNDS of these General Conditions of Sale.

Resale

The Customer undertakes not to buy products for the sole purpose of reselling them or reselling products created by www.vito-nebula.com.

DELIVERY

Delivery costs are to be paid in addition to purchases. The additional customs fees that may apply depending on the country of destination for the delivery are the responsibility of the Customer: the latter agrees to pay them by accepting these General conditions of sale.

www.vito-nebula.com reserves the right to refuse or cancel any order:
Causing unexpected delivery costs;
The carrier cannot or can no longer ensure the delivery of the package in the country and/or region of destination.

The products are shipped to the address indicated by the Customer. The delivery address cannot be changed as soon as the package is handed over to the carrier. It is the Customer's responsibility to verify the accuracy of the information he provides when placing an order.

The delivery times indicated include the processing time by www.vito-nebula.com (original works) and/or its provider (prints) from Monday to Friday (except holidays), exceptional absences of which the Customer will be kept informed in advance on www.vito-nebula.com, as well as the carrier's deadlines.

www.vito-nebula.com can not be held responsible for delays or loss of parcels by the carrier.

In the event of loss on the part of the carrier including one or more original works, the latter may not be sent again, each work existing in a single copy. The Customer will be fully reimbursed according to the conditions of reimbursement indicated in Article 4. RIGHT OF WITHDRAWAL, RETURNS AND REFUNDS.


RIGHT OF WITHDRAWAL, RETURNS AND REFUNDS
Original works

Withdrawal period :
In accordance with the legal provisions in force, the Customer has a period of fourteen (14) days from receipt of the work to exercise his right of withdrawal, without having to justify his decision.
The Customer notifies his decision of withdrawal via the contact form on www.vito-nebula.com or by email to contact@vito-nebula.com. He then has a period of fourteen (14) days from this notification to return the work.

Fees and conditions of returns

The direct costs of return are borne by the Customer. The latter also undertakes to subscribe to the insurance carrier covering at least the purchase value of the original work(s) acquired that he would like to return.
Reimbursement of the sums paid, including standard delivery costs, will be made within fifteen (15) days of receipt of the work from www.vito-nebula.com and after having noted the good condition of the work. The refund is made using the same means of payment as that used by the Customer during the transaction.

Status of original works returned

The original works must be returned in a condition that allows them to be put back on sale.

In accordance with the applicable regulations, the Customer may be held liable in the event of depreciation of the work resulting from improper handling of the latter.

In case of deterioration(s) observed during the return:
A discount may be applied corresponding to the loss of value of the work (including restoration costs or decrease in market value);
In the event of damage making it impossible to put the work back on sale, a total depreciation may be applied, which may lead to the absence of reimbursement.

www.vito-nebula.com reserves the right to request proof of good faith from the Customer in any form whatsoever, as well as to reject evidence provided by the Customer that would suggest that the latter has resorted to the use of Artificial Intelligence. In case of serious doubt about the use of Artificial Intelligence and / or in the absence of evidence deemed credible, www.vito-nebula.com reserves the right to refuse to proceed with the reimbursement of the Customer.

The Customer undertakes to return the original work under conditions that ensure the good safety of its condition during transport.

Prints

In accordance with the provisions of Article L221-28 of the Consumer Code and the European directive on consumer rights, the right of withdrawal does not apply to goods made on demand.
Consequently, any print order is firm and final as soon as it is validated.
However, for commercial purposes, the following provisions may apply subject to prior acceptance by www.vito-nebula.com:
- Order not yet entered into production: the Customer can request the cancelation of his order and obtain a full refund, including delivery costs.
- Order in production but not shipped: only shipping costs are refunded.
- Order produced and shipped: no refund can be granted.

However, the legal guarantees of conformity and hidden defects in the event of defective or non-compliant products remain applicable, in accordance with the regulations in force.

www.vito-nebula.com reserves the right to request proof of good faith from the Customer in any form whatsoever, as well as to reject evidence provided by the Customer that would suggest that the buyer has resorted to the use of Artificial Intelligence. In case of serious doubt about the use of Artificial Intelligence and / or in the absence of evidence deemed credible, www.vito-nebula.com reserves the right to refuse to proceed with the reimbursement of the Customer.

LEGAL GUARANTEES

The products offered for sale on www.vito-nebula.com benefit from the legal guarantee of conformity according to articles L217-4 to L.217-12 of the Consumer Code, as well as the guarantee against hidden defects according to articles 1641 to 1648 and article 2232 of the French Civil Code.

INTELLECTUAL

By purchasing an original work or a print on www.vito-nebula.com, the customer acquires the material support.

No sale of original works or prints entails the assignment of intellectual rights or the right to reproduce the various products offered for sale.

APPLICABLE LAW

These General conditions of sale are governed by French law.
